The following groups report to the PLWG:

Working Group Activity - NAIC 2008 Summer National Meeting

The Producer Licensing Working Group met on Sunday, June 1, 2008.

During this meeting, the Producer Licensing Working Group:

  • Considered the adoption of conference call meeting minutes from May 20, 2008
  • Discussed the NAIC Uniform Applications. The working group adopted the revisions to applications on May 20, 2008.
  • Discussed the Independent Adjuster Licensing Guideline. The working group reopened the adopted guideline for brief discussion regarding the language in Section 4- Exceptions to License Requirement. The working group deleted subsections 6A(3) and 6B(2) and added the following drafting note: “Employee of the authorized affiliate insurer may be considered under this exemption with the Commissioner’s consent.”
  • Discussed the priority received from the NAIC Officers to the Producer Licensing Working Group to evaluate certain findings and issues in the Producer Licensing Assessment Aggregate Report. The working group was asked to review the uniform licensing standards and recommend the standards that should be considered professional licensing standards. The working group adopted a memo outlining the professional standards.
  • Discussed the second priority received from the NAIC Officers to the Producer Licensing Working Group to evaluate certain findings and issues in the Producer Licensing Assessment Aggregate Report. The working group was asked to review the uniform licensing standards of low compliance and identify those standards that are not generally supported by the local industry organizations at the state legislative level. The working group will continue working on their review of the standards through conference calls for completion by the end of June 2008.
  • Discussed the continuing education issues. The working group was informed a survey is available for completion. The main issues concern states’ required announcements and roster forms.
  • Received an update on the State Licensing Handbook. A new draft is available for review and comments will be accepted until July 11, 2008.
  • Received an update from NIPR regarding numerous state requests that remain open. The working group discussed creating a schedule and contact point to resolve open issues in the future.
  • Discussed Producer Licensing Coalition initiatives and the working group priorities for 2008. Based upon a memo from the NAIC’s from the NAIC’s Executive Committee to The D Committee, the Producer Licensing Working Group will evaluate certain findings and issues in the Producer Licensing Assessment Aggregate Report. The working group reviewed two priorities to be completed by 2008 Fall National Meeting. The priorities are as follows: (1) compliance with the uniform licensing standards to identify those standards where more specific interpretive guidance is warranted or revisions to the standards are necessary and (2) and full adoption, and uniform interpretation, of the commercial lines multi-state exemption and the commission sharing exemption across all states.

Action Items:

  • The working reopened and adopted new language for the Independent Adjuster Licensing Guideline.
  • The working group adopted memo outlining professional licensing standards for producers.
  • The working group adopted amendments to the Uniform Applications.

The Independent Adjuster Licensing Guideline current draft: This guideline was adopted by the D Committee at the 2008 Summer National Meeting. The guideline will be presented to the Executive Committee for adoption at the 2008 Fall National Meeting.

NAIC Producer Licensing Report:

NAIC Uniform Applications

The Producer Licensing Working Group has adopted the revisions for the NAIC Uniform Applications for Individual and Business Entity. All 3 application types were open for review - the initial , renewal and reinstatement . The 2006 applications are attached under committee documents below. The 2008 will become available January 1, 2009. The application revisions will be presented to the D Committee for adoption before moving forward to the Executive Committee. This is the only time during the next two years that the Producer Licensing Working Group will consider changes to the applications. The adopted applications will be available below prior to the 2008 Summer National Meeting.

Documents regarding the NAIC Officer Charges for 2008:

The Market Regulation and Consumer Affairs D Committee adopted the Professional Licensing Memo drafted by the PLWG at the 2008 Summer National Meeting. The memo will be presented to the Executive Committtee at the 2008 Fall National Meeting for final adoption.

The Producer Licensing Working Group adopted the Low Compliance Recommendation on July 23, 2008 during a PLWG Conference Call. The Recommendation will be presented to the market Regulation and Consumer Affairs D Committee at the 2008 Fall National Meeting.
