Statistical Information (C) Task Force
Conference Calls

The Statistical Information (C) Task Force met via conference call June 19, 2007, and adopted a blanks proposal to revise Supplement A to Schedule T of the annual statement. The changes include elimination of “Medical Malpractice policies effective prior to January 1, 1976”; modifying “Other health care professionals, including dentists” to provide more detail on types of professionals in this category, including chiropractors and podiatrists; and providing alpha codes in the instructions for the four designations.

During the June 19, 2007, conference call the Task Force also discussed the June 11, 2007, draft of the Medical Malpractice Closed Claim Reporting Model Law. Various concerns were raised by interested parties regarding the need for reporting of surplus lines entities and risk retention groups. However, the Task Force believes the reporting from all entities is needed and will remain in the model. The confidentiality provisions of the draft were also discussed and since Task Force consensus on confidentiality issues may be impossible, the Task Force decided to seek Property and Casualty Insurance (C) Committee guidance as this is a public policy issue.

In July, by E-mail review and vote, the Task Force approved the 2005 Commercial Lines Competition Database Report.

The Task Force met via a Regulator to Regulator conference call September 5, 2007, and approved the 2004/2005 Auto Insurance Database Report.

During the conference call September 18, 2007, the Task Force discussed the letter to send to the Property and Casualty Insurance (C) Committee regarding confidentiality provisions of the model presently being developed. Wednesday, September 26, the Task Force approved a letter regarding the confidentiality issue. The Task Force is seeking guidance from commissioners on whether the model law should include a provision that ensures that individual closed claim data will be kept confidential by the state insurance department that collects the data required by the model law and if so, the level of confidentiality that should be conferred upon the data. Once this issue is resolved, the Task Force believes that it can move fairly quickly to complete the drafting of the model law and submit it to the Property and Casualty Insurance (C) Committee for approval in a timely fashion.

The Statistical Information (C) Task Force has a conference call scheduled for October 16, 2007 and during the next quarter it expects to approve the 2005 Dwelling Fire, Homeowners Owner-Occupied, and Homeowners Tenant and Condominium/Cooperative Unit Owner’s Insurance report.
