National Treatment and Coordination (E) Working Group

The National Treatment and Coordination (E) Working Group met on Monday, March 31, 2008.
During this meeting the Working Group:
- Adopted minutes of the Feb. 6, 2008 conference call. Discussed and agreed to the Berkshire Hathaway Assurance Corporation (BHAC) pilot project. Reviewed and discussed a draft reinsurance diagram. It was determined more examples were needed before adopting. Reviewed and discussed Analysis of Business Plan for the Best Practices Handbook. This item was deferred to the Issues Subgroup for review.
- Received summaries from the Issues Subgroup of February 20, 2008 and March 19, 2008. Reviewed proposed changes to Forms 1E, 1P and Instructions for Primary application to remove references to “certified by domiciliary state” and Form 2C to include effective dates for redomestication and change of city. Discussed survey results and grid for Primary Redomestication. Reviewed proposed Best Practices for the biographical affidavit to be included in the Company Licensing Best Practices. Discussed proposed changes to the biographical affidavit and supplemental page by the joint trade group of the American Insurance Association (AIA), the American Health Insurance Plans (AHIP), the American Council of Life Insurers (ACLI), Property Casualty Insurers Association of America (PCI), and the National Association of Mutual Insurance Companies (NAMIC).
- Adopted Forms 1E, 1P, 2C and Instructions for Primary application.
- Reviewed Redomestication chart from the results of a recent survey to the states on the requirements for a primary redomestication, to be used as an industry reference guide.
- Received and discussed a proposal for the Biographical Affidavit Best Practices for the Company Licensing Best Practices Handbook. This item pending review of the NAIC legal department.
- Reviewed and discussed a request from the Texas department for a reinsurance diagram to be included with the expansion application. Discussed a comment letter from Les Hatley (Invotex) to reduce the amount of financial information based on the risk-based prioritization approach described in the Company Licensing Best Practices Handbook and detailed reinsurance information should be requested on an as-needed basis.
- Received an update on the BHAC pilot project. 44 states have approved the application. One state has withdrawn the application and five state are still in the review process, awaiting documentation from BHAC.
- Discussed a potential pilot project for the merger of John Hancock Life Insurance Company and John Hancock Variable Life Insurance Company into John Hancock Life Insurance Company U.S.A on Dec. 31, 2008. This merger will incorporate the cooperation of three areas; policy forms, producer licensing and corporate licensing. The most critical area will be the transfer of policy forms to the surviving company.
