The Professional Employer Organization Model Law (C) Working Group did not meet, but its PEO Guidelines Implementation Paper Drafting Group met by conference call on three occasions during Second Quarter 2009. The PEO Guidelines Implementation Paper Drafting Group conducted the following activities:
- Held a conference call April 14, in which the first draft “Implementation Commentary: Guidelines for Regulations and Legislation on Workers’ Compensation Coverage for Professional Employer Organization Arrangements” (the Draft PEO Paper) was presented for discussion. The purpose of the Draft PEO Paper is to be of assistance to the states in implementing the Guidelines for Regulations and Legislation on Workers’ Compensation Coverage for Professional Employer Organization Arrangements (PEO Guidelines), which was adopted by the NAIC in 2007. The Draft PEO Paper is considered important due to the complexity of the PEO Guidelines and the number of challenges regulators face in this area. While this first Draft PEO Paper lacked two sections, it was considered appropriate regarding overall assembly.
- Held a conference call May 12, in which Version Two of the Draft PEO Paper was presented for discussion, which included the previously missing two sections: the Regulatory Framework for PEOs; and Self-Insurance and Loss-Sensitive Coverage. It was agreed during the conference call that the Draft PEO Paper should be prepared for its first public exposure at the Workers’ Compensation (C) Task Force meeting to be held during the Summer National Meeting. The reason for first exposing the Draft PEO Paper before the Task Force is to obtain initial comment from regulators and interested parties, before it is fully vetted by the Professional Employer Organization Model Law (C) Working Group during the Fall National Meeting.
