Winter 2009 Meeting Summaries Index

The Professional Employer Organization Model Law (C) Working Group of the Workers’ Compensation (C) Task Force did not meet during the Winter National Meeting, but met via conference call Nov. 6, 2009. During this meeting, the Working Group:

  • Discussed the Sept. 22 draft “Implementation Commentary: Guidelines for Regulations and Legislation on Workers’ Compensation Coverage for Professional Employer Organization Arrangements” (i.e., a draft professional employer organization guidelines implementation paper). The purpose of the draft is to assist states, professional employer organizations, and the insurance industry with implementation of a regulatory framework consistent with the Guidelines for Regulations and Legislation on Workers’ Compensation Coverage for Professional Employer Organization Arrangements (the PEO Guidelines), adopted by the NAIC in 2007. The PEO Guidelines were designed to provide the states with a regulatory framework for addressing the most significant workers’ compensation issues that have arisen to date in professional employer organization relationships, with an emphasis on a clear allocation of the respective rights and responsibilities of professional employer organizations, clients and insurers.
  • Determined that the Sept. 22 draft “Implementation Commentary” was ready for broader exposure and referral to the Workers’ Compensation (C) Task Force. It was agreed that additional revision to the draft’s “Appendix B” (NCCI Alternatives and Technical Supplement on Data Reporting) would be necessary in order to make the appendix more comprehensive and reader-friendly. It was noted that upon Task Force adoption of the draft “Implementation Commentary,” which is not expected to occur before the 2010 Spring National Meeting, it will need to be decided whether the document should become a separate white paper or an attachment of supplemental information to the PEO Guidelines.
