The Producer Licensing (EX) Working Group met Dec. 6, 2009. During this meeting, the Working Group:

  • Adopted the minutes from its Nov. 2, 2009, conference call.

  • Discussed the status of its limited lines charge for 2009. The Working Group has presented a report to the Producer Licensing (EX) Task Force describing the work completed at the end of 2009. The Working Group requested that the Task Force review their progress for the year and provide further guidance for 2010.

  • Received an update from the Federal Emergency Management Agency (FEMA), which offered assistance to state insurance departments on their advanced flood insurance training program. The Working Group was asked to encourage state insurance departments and their vendors to waive the fee for filing continuing education credits for National Flood Insurance Program (NFIP) training. In addition, FEMA asked the Working Group to discuss other ways that the NAIC can encourage state insurance departments to give special consideration to NFIP training-related issues.

  • Discussed the status of the NAIC/NIPR Attachments Warehouse for reporting of actions. The states were encouraged to issue and promote the model bulletin for the Attachments Warehouse.

  • Received an update from NIPR regarding the adding of a question outside of the NAIC uniform application on the electronic process for new and renewal application that asks individuals whether they have, or will be, submitting information to the Attachments Warehouse.

  • Received a status on revisions to the NAIC uniform application. The Working Group was notified that the implementation date for the applications will be Jan. 29, 2010.

  • Discussed possible tasks for 2010:
    • Provide oversight and ongoing updates to the State Licensing Handbook.
    • Further discussion on limited lines.
    • Provide assistance to FEMA encouraging state insurance departments to waive the filing fee for continuing education credits for NFIP training.
    • Develop an NAIC uniform application for claims adjusters.
    • Establish electronic warehouse capabilities for state insurance departments to submit and file formal documents that can be reviewed for potential actions that might arise at a later date.
    • Establish guidelines for a uniform producer licensing examination process.
    • Serve as an informal focus group with NAIC staff for the development and delivery of State Licensing Handbook training for state insurance departments.
    • Review the process for effective dates for organizational name changes for business entities.
    • Further review of the Attachments Warehouse and whether producers should have the ability to remove an action or provide supplemental documents to that effect.
    • Review whether guidance needs to be provided to producers regarding service of process.
    • Review whether producers should have ability to control items added to the Attachments Warehouse.
